These Terms of Service (“Terms”) govern your use of AI Podcast Generator (“the Service”) operated by Smallest AI at podcast.smallest.ai. By using the Service, you agree to these Terms.

1. The Service

AI Podcast Generator converts text content (articles, PDFs, URLs) into AI-generated podcast audio with multiple voices and formats. The Service is provided “as is” without warranties of any kind.

2. Usage Tiers

Free tier: 10 generations per device, no account required. After 10 generations you may be asked to provide an email address.
Credit pack: 20 podcast credits for $9.99 (one-time, no expiry).
Pro: Unlimited generations + voice cloning for $14.99/month, billed via Stripe.
Bring Your Own Key (BYOK): Use your own Smallest AI API key for unlimited generations.

Extended-length podcasts cost 2 credits per generation; Short and Standard cost 1 credit each.

3. Acceptable Use

You agree NOT to use the Service to generate content that:

Infringes on copyright, trademark, or other intellectual property rights of others.
Is defamatory, harassing, threatening, or hateful toward any person or group.
Contains explicit sexual content, especially involving minors.
Promotes violence, terrorism, or illegal activities.
Impersonates real persons in a misleading or deceptive manner.
Violates the privacy of others.
Spreads misinformation about elections, public health, or safety.
Attempts to circumvent usage limits or abuse the Service’s infrastructure.

We reserve the right to terminate accounts and refuse service to anyone who violates these rules.

4. Content Ownership

You retain ownership of the content you submit to the Service.
You retain ownership of the podcasts generated from your content.
You are responsible for ensuring you have the right to use any source material (articles, PDFs, etc.) you submit.
By submitting content, you grant us a limited license to process it for the sole purpose of generating your podcast.

5. AI-Generated Content Disclaimer

Podcasts are generated by AI and may contain errors, inaccuracies, or hallucinated information. You are responsible for reviewing generated content before publishing or distributing it. We do not guarantee the accuracy, completeness, or quality of AI-generated outputs.

6. Payment and Refunds

All payments are processed by Stripe and subject to Stripe’s terms.
Pro subscriptions auto-renew monthly until cancelled.
You can cancel your Pro subscription at any time via the billing portal accessible through Settings.
Credit pack purchases are non-refundable except as required by law.
Pro subscription refunds are issued at our discretion within 7 days of purchase if no significant usage has occurred.

7. YouTube Integration

If you opt to publish podcasts to YouTube, you agree to comply with YouTube’s Terms of Service and the Google Privacy Policy. You are responsible for the content you publish.

We use YouTube data only to upload videos you explicitly request. See our Privacy Policy for full details.

8. Service Availability

We strive to keep the Service available but do not guarantee 100% uptime. The Service may be unavailable due to maintenance, third-party outages (e.g., Stripe, AI providers), or other factors outside our control.

9. Limitation of Liability

To the maximum extent permitted by law, Smallest AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

10. Termination

We may terminate or suspend access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (such as ownership, disclaimers, and limitation of liability) shall survive termination.

11. Changes to Terms

We may modify these Terms at any time. The “Last updated” date at the top reflects when changes were made. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts located in Bengaluru, India.
